END USER LICENSE AGREEMENT (EULA)

Effective Date: 18 January 2025

1. INTRODUCTION This End User License Agreement ("EULA") is a legal agreement between you (the "User") and Lenny.fm, including its associated website Creators.Lenny.fm ("Platform", "we", "our", or "us"). By accessing or using our Platform, you agree to be bound by this EULA. If you do not agree to these terms, you must discontinue use immediately.

2. LICENSE GRANT Subject to compliance with this EULA, Lenny.fm grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose.

3. RESTRICTIONS You agree not to:

  • Modify, distribute, sublicense, or create derivative works from the Platform.
  • Reverse engineer, decompile, or disassemble any part of the Platform.
  • Use the Platform for unlawful purposes or in violation of any applicable laws.
  • Attempt to interfere with or compromise the security of the Platform.

4. USER ACCOUNTS To access certain features, you may be required to create an account. You agree to provide accurate information and maintain the confidentiality of your credentials. You are responsible for all activity under your account.

5. PAYMENTS AND SUBSCRIPTIONS

  • Lenny.fm provides subscription-based services for Users to support podcast creators.
  • Payments are processed securely through Stripe.
  • Fees are non-refundable except as required by applicable consumer laws.
  • We reserve the right to modify subscription fees with prior notice.

6. INTELLECTUAL PROPERTY All content on the Platform, including but not limited to trademarks, logos, text, and software, is owned or licensed by Lenny.fm and protected by Australian, UK, European, and US copyright and intellectual property laws.

7. TERMINATION We reserve the right to suspend or terminate your access to the Platform at any time if you violate this EULA.

8. PRIVACY AND DATA PROTECTION Your use of the Platform is subject to our Privacy Policy, which complies with the General Data Protection Regulation (GDPR) (EU/UK), the Australian Privacy Act 1988 (Cth), and the California Consumer Privacy Act (CCPA, USA).

9. DISCLAIMERS AND LIMITATIONS OF LIABILITY

  • The Platform is provided "as is" without warranties of any kind.
  • We do not guarantee uninterrupted access or the absence of errors.
  • To the maximum extent permitted by law, we disclaim liability for damages arising from the use of the Platform.

10. GOVERNING LAW AND DISPUTE RESOLUTION This EULA shall be governed by the laws of Australia, the United Kingdom, the European Union, and the United States, depending on the User’s location. Any disputes will be resolved through binding arbitration or appropriate legal jurisdiction.

11. CHANGES TO THIS AGREEMENT We may update this EULA from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised terms.

E-COMMERCE TERMS AND CONDITIONS

1. INTRODUCTION These E-Commerce Terms and Conditions ("Terms") govern the use of Lenny.fm and Creators.Lenny.fm ("Platform," "we," "our," or "us") for transactions involving digital goods, services, and subscriptions. By using our Platform, you agree to comply with these Terms.

2. ELIGIBILITY

  • You must be at least 18 years old or have legal parental/guardian consent to use our services.
  • By using the Platform, you confirm that you have the legal capacity to enter into this agreement.

3. PRODUCTS AND SERVICES

  • Lenny.fm provides subscription-based financial support services for podcast creators.
  • Creators.Lenny.fm enables content creators to receive payouts and manage their earnings.
  • All products and services are digital and non-physical.

4. PRICING AND PAYMENT

  • All prices are listed in [insert default currency] and include applicable taxes unless stated otherwise.
  • Payments are processed securely via Stripe.
  • We reserve the right to change prices at any time without prior notice, but changes will not affect existing subscriptions.

5. SUBSCRIPTIONS AND BILLING

  • Users can subscribe to support podcast creators for a recurring monthly fee.
  • By subscribing, you authorize recurring charges until cancellation.
  • You may cancel your subscription at any time through your account settings; cancellations take effect at the end of the billing cycle.

6. REFUNDS AND CANCELLATIONS

  • Due to the nature of digital services, refunds are generally not provided.
  • Refund requests may be reviewed on a case-by-case basis in accordance with applicable consumer protection laws.

7. INTELLECTUAL PROPERTY

  • All content and software on the Platform are protected by Australian, UK, European, and US copyright and intellectual property laws.
  • Users may not copy, distribute, or modify any content without prior written consent.

8. USER ACCOUNTS

  • Users are responsible for maintaining the confidentiality of their account credentials.
  • We reserve the right to suspend or terminate accounts found in violation of these Terms.

9. LIMITATION OF LIABILITY

  • We provide services "as is" and do not guarantee uninterrupted access or the absence of errors.
